ROTFLMHO. A leftist-liberal group's *accusation* and it's doubtful
it'll hold up in court.
Lemme help you out with *hint* and a few of the *basics* sonny:
Hint: From the URL you posted (above):
"Conceding federal courts have been loath to rule against an
administration's use of military force..." That just about sums up
how far their case will go...
A few of the *basics*:
1. Examples of military conflicts never delcared "War" by Congress:
a. First Barbary War
b. Korean War
c. Vietnam
d. Iraq (Bush - 41)
(FWIW, Name the US President that was sucessfully sued for sending
troops to those places listed in a through d, even though Congress
never declared formally war)
2. From the URL your posted (above):
"...the authorization to use force was meant...to enforce United
Nations Security Council resolutions..."
3. "This foreign affairs power is exclusive: it is "the very delicate,
plenary and exclusive power of the President as sole organ of the
federal government in the field of international relations - a power
which does not require as a basis for its exercise an act of
Congress." United States v. Curtiss-Wright Ex****t Corp.,
299 U.S. 304, 320 (1936)." http://www.usdoj.gov/olc/warpowers925.htm
Let's see if you can disprove ANYthing I've posted here with evidence,
while refraining from rhetoric, sophistry, ad hominem and soundbites.
